Dive and Cruise Limited (“Dive and Cruise”, “we”, “us”, “our”) operates the websites including but not limited to www.diveandcruise.com, www.dive-and-cruise.com and country-specific extensions (“Website”). These Terms and Conditions ("Terms", "Agreement") govern your use of the Website, booking platform, reservation services, and any related services we provide as an intermediary agent between guests and liveaboard operators & dive resorts.
www.dive-and-cruise.com was our original domain, first registered in 2009.
www.diveandcruise.com is our second domain, registered since 2012.
By accessing our websites or making a reservation through Dive and Cruise Ltd., you acknowledge that you have read, understood, and agree to these Terms.
These Terms may be updated by us from time to time; updated versions will be posted here and effective immediately without individual notice.
If you do not agree to these Terms, you must cease using the websites and services immediately.
2. Definitions of Words
Unless expressly defined otherwise in this Agreement:
Agent:
Dive and Cruise Ltd., acting solely as an intermediary agent facilitating reservations between guests and liveaboard operators.
Operator:
The entity providing liveaboard diving, adventure packages, and similar services, receiving guests and payment.
Diver(s) / Guest(s):
Any person making a booking through Dive and Cruise or traveling on a liveaboard trip booked via our services.
Package:
A liveaboard diving trip or cruise offering defined services, cabin space, itineraries, and inclusions as advertised by the Operator.
Lowest Price Guarantee:
Assurance that Dive and Cruise Ltd. offers the lowest available price online for their holiday package.
Availability:
The possibility to join a liveaboard trip with space(s) left for reservation.
Reservation:
A confirmed agreement between Guest and Operator facilitated by Dive and Cruise.
Cancellation Fee:
Any fee charged to a Guest for cancellation of a booking.
Special Circumstance:
Events beyond reasonable control including epidemics, natural disaster, political unrest, war, acts of terrorism, or governmental action.
Confirmation Voucher:
The official document issued by Dive and Cruise Ltd. after payment confirming your reservation.
3. Scope of Service
3.1 Dive and Cruise operates as a booking intermediary agent, not as a travel agency, tour operator, or service provider performing offshore travel services (such as flights, hotels, transfers, or land tours), unless expressly agreed.
3.2 Dive and Cruise Limited provide a platform where Guests can browse, request and book liveaboard Packages. All reservations are subject to the terms, conditions, policies, and schedules of the Operators.
3.3 Dive and Cruise Limited shall not be held liable for any inaccuracies or errors in vessel descriptions, itineraries, schedules, pricing, or photographs provided by liveaboard operators and displayed on our website. All schedules and rates are supplied directly by the respective operators and are typically reviewed and updated by us on an annual basis (generally in July/August). However, operators may implement changes at any time during the year without prior notice to Dive and Cruise Limited. While we make every reasonable effort to ensure that all information remains accurate and up to date, we cannot guarantee that the content displayed on our website will always reflect the most recent modifications made by the operator.
3.4 All booking forms submitted through this website are requests only and do not constitute an instant or confirmed reservation. Upon receipt of your request, our dive specialists will verify availability with the liveaboard operator and provide you with the most up-to-date pricing, trip details, and confirmation status. Once you formally accept the offer provided by Dive and Cruise Ltd, we will secure your space(s) with the operator and issue an invoice for payment. Your booking is confirmed only after the required payment has been received in accordance with the operator's terms.
4. Reservations
4.1 All reservations are processed through our Website or direct communication with our team of dive agents.
4.2 Reservations are requests until confirmed by the Operator following acceptance of the terms offered. Dive and Cruise will issue an invoice upon confirmation.
4.3 Unless otherwise stated, bookings are confirmed only after full payment or payment of a required deposit received by us.
4.4 Guests agree to supply accurate personal details, passport numbers, dive certifications, medical declarations, emergency contacts, and any additional documents required by the Operator. Failure to provide such information may result in cancellation in accordance with the operator's policies.
4.5 Any reservation made through Dive and Cruise Ltd constitutes a direct contractual agreement between the Guest and the applicable operator. Dive and Cruise Ltd is not a party to, and assumes no contractual liability under, such agreement.
4.6 Dive and Cruise Ltd provides its reservation services to Guests free of charge. We do not add any service fees, mark-ups, or additional charges to the rates published by the trip operators. Operators remunerate Dive and Cruise Ltd. via commission.
4.7 Dive and Cruise Ltd is responsible for the proper administration and execution of the reservation process as an intermediary booking agent. However, Dive and Cruise Ltd does not own, operate, or control the liveaboard vessels or travel packages provided by third-party operators, and therefore assumes no responsibility or liability for the performance or quality of the services supplied by such operators.
4.8 Dive and Cruise Ltd will make every reasonable effort to assist customers in emergency or adverse situations; however, we shall not be held liable for any services or outcomes arising from such circumstances.
5. Special Requests
5.1 Guests may submit special requests (e.g., dietary requirements, cabin preferences, gear rental etc.). Operators have sole discretion to fulfill such requests. Dive and Cruise Ltd. is not liable for the availability or condition of these requests.
5.2 Dietary requests should be limited to essential needs, including allergies or religious requirements. Guests acknowledge that certain remote destinations may not accommodate all preferences.
5.3 Guests wishing to celebrate special occasions (birthdays, anniversaries, etc.) must inform Dive and Cruise Ltd. during booking.
6. Guest Responsibilities
6.1 Guests must comply with operator standards and requirements. Failure to do so may result in denied participation and forfeiture of the trip.
6.2 Guests are solely responsible for securing necessary visas, health documentation, and entry requirements.
6.3 Guests are responsible for transportation to/from embarkation points. Recommendations may be provided but we are not liable for transport services.
6.4 Guests must obtain comprehensive travel and dive insurance covering all adventure-related risks and trip cancellation risks.
6.5 Guests must hold valid diving certifications and meet operator-specific dive experience requirements.
6.6 Guests must comply with operator rules; violations may result in denied services or participation.
6.7 Guests should consult relevant governmental advisories, vaccination recommendations, and health requirements.
6.8 Guests should inquire about vaccination and prevention of tropical ailments with a doctor and follow their advice.
6.9 Guests delayed in transit are responsible for all associated costs to join the trip.
7. Lowest Price Guarantee
7.1 We have an agreement with our operators to offer the best price available, so our guests are guaranteed the lowest price online at the time of booking.
7.2 As an authorized booking platform, we display prices in strict accordance with our operators' published rates, ensuring a consistent and fair pricing experience for all guests.
7.3 Guests are automatically enrolled in our loyalty program after the first booking with us, which may provide discounts or special offers on future bookings.
7.4 The prices shown on our websites use a multi-currency display, so prices may vary slightly due to exchange rate fluctuations.
7.5 If you find any other website and/or agent providing lower rates, Dive and Cruise Ltd. will match or exceed it. You just need to provide us the details of the other deal including a link to the website where it can be found. The deal should be for the same product (same boat, same dates, same cabins, same booking conditions, same included and excluded extras, etc.).
7.6 If the deal you found through another website and/or agent provides special membership rates, loyalty programs, or if the other agent doesn't display rates before you have requested them, our best price guarantee doesn't apply. In any case, we will do our best to make you an offer you cannot refuse.
8. Payments
8.1 Bookings are valid only upon receipt of full payment.
8.2 A deposit payment is due within 5–7 days from confirmation of the reservation. Full payment may be required for last-minute bookings.
8.3 A Confirmation Voucher will be sent to you via email after we receive payment, serving as both proof of booking and invoice.
8.4 Payments may be made via bank transfer, major credit cards, PayPal, digital currency (BTC, ETH), or third-party payment processors such as Flywire.
8.5 Guests are responsible for transaction-related costs; refunds are issued in the original payment currency.
8.6 Any refund by Dive and Cruise Ltd will be made in the same currency as the original payment.
9. Cancellations and Amendments
9.1 All cancellations must be submitted in writing via email.
9.2 All guest cancellations are subject to the operator's cancellation policy. Applicable policies may vary by reservation, and guests must agree to the specific terms provided by the operator, as detailed on the invoice.
9.3 In case of amendment or cancellation with a (partial) refund, refunds will be subject to applicable fees, including bank, exchange, and handling charges.
9.4 Dive and Cruise Ltd. will process refunds within ten (10) business days of receipt from the operator. Actual receipt may vary depending on bank processing times.
9.5 Dive and Cruise Ltd. cannot issue refunds without operator reimbursement. We strongly recommend that guests obtain comprehensive travel cancellation insurance. In the event of an incident, we will fully assist guests with insurance claims.
9.6 No-shows or early departures are treated as cancellations with no refund entitlement.
9.7 Operators may modify cabin allocations or itineraries; Dive and Cruise Ltd. is not liable for such changes.
9.8 The operator may substitute the vessel with another of comparable standard while maintaining the same itinerary. Dive and Cruise Ltd. shall not be liable for any disputes arising from such substitution.
10. Special Circumstances
10.1 The operator may cancel, reschedule, or offer an alternative package if weather or safety conditions prevent services on the confirmed date. In such cases, Dive and Cruise Ltd. will follow the operator's applicable policy.
10.2 If the operator is permanently unable to provide the package due to force majeure events, including epidemics, natural disasters, political unrest, criminal acts, or war, the guest shall be entitled to either a rescheduled trip under the same conditions or a full refund.
10.3 In special circumstances, we will use commercially reasonable efforts to notify you promptly. Any applicable refunds will be issued in full, without deduction of amounts received from the operator.
11. Liability
11.1 Reservations constitute agreements directly between guests and operators; Dive and Cruise Ltd. is not responsible for operator performance or service quality.
11.2 Guests agree to waive claims against Dive and Cruise Ltd. for unforeseen circumstances.
11.3 Dive and Cruise Ltd. is not liable for personal injury, property damage, or death arising from operator services or activities.
11.4 Dive and Cruise Ltd cannot be held accountable for wrong information published on partner websites.
11.5 Dive and Cruise Ltd.'s liability for any errors in reservation services shall be limited to the commission received from the operator for the relevant booking.
11.6 Dive and Cruise Ltd. and/or the operator shall not be liable for any delays, changes, or cancellations arising from force majeure events, including acts of God, political unrest, war, terrorism, or other circumstances beyond the operator's reasonable control.
12. Complaints
12.1 Dive and Cruise Ltd. acts solely as an agent and is not responsible for the quality of operator services. Guests dissatisfied with operator services should first address the captain or cruise directors.
12.2 Post-trip complaints may be submitted to Dive and Cruise Ltd. for feedback purposes.
12.3 For complaints regarding Dive and Cruise Ltd.'s services, please submit them via our contact form. We will review and address them promptly, prioritizing your satisfaction.
13. Website Use
13.1 You shall use the websites solely for personal, non-commercial purposes and shall not copy, reproduce, distribute, display, or exploit any content, data, or services for commercial or competitive purposes without the prior written consent of Dive and Cruise Ltd.
13.2 All content on this website is copyrighted and may not be reproduced, distributed, or used commercially without the express written consent of Dive and Cruise Ltd.
13.3 Visitors shall not submit fraudulent bookings or advertise services via the websites.
13.4 Posting reviews or comments grants Dive and Cruise Ltd. a non-exclusive license to use such content.
13.5 Dive and Cruise Ltd. may remove content deemed offensive or inappropriate.
14. Governing Law
Dive and Cruise Ltd. is incorporated in Hong Kong and these Terms are governed by and construed in accordance with the laws of Hong Kong.
The English version of these Terms shall prevail over any translated versions.
